Teamsters Pension Lawsuit
Martin & Bonnett, PLLC has filed a class action lawsuit against the Western Conference of Teamsters Pension Plan, alleging that the Plan has systematically underpaid married retirees and surviving spouses. Additionally, the lawsuit challenges the Plan’s unlawful suspension of benefits for retirees who return to non-covered employment.
What is the Lawsuit About?
This lawsuit asserts that the Western Conference of Teamsters Pension Plan violated the Employee Retirement Income Security Act (“ERISA”) by engaging in the following unlawful practices:
Underpaying Married Retirees and Surviving Spouses – The Plan allegedly failed to provide married retirees and their spouses with benefits that are actuarially equivalent to those paid to unmarried retirees, as required by law.
Providing Inadequate Disclosures – Retirees and their spouses were not given proper information regarding the true value of their pensions, leading to financial hardship and uncertainty.
Unlawful Suspension of Benefits – Retirees who returned to work in non-covered employment had their benefits suspended under an unlawful policy.
A copy of the Second Amended Complaint is available [HERE]. The Western Conference of Teamsters has denied these allegations.
Who’s Included in the Lawsuit?
The lawsuit seeks to represent the following groups:
Married retirees and surviving spouses who began receiving pension benefits on or after January 1, 2008.
Retirees whose benefits were suspended for working in non-covered employment.
Retirees who selected a Benefit Adjustment Option and had their benefits suspended before the age of 62 or 65.
Current Case Status
This case is actively progressing through the courts:
June 2024 – The Court denied the Defendants’ motion to dismiss, allowing the case to move forward. You can view the Court’s order [HERE].
January 17, 2025 – Plaintiffs filed a Motion for Class Certification, a critical step in securing justice for affected retirees. A copy of the motion is available [HERE].
Why The Case Matters
The outcome of this lawsuit could have a significant impact on thousands of retirees and their spouses. If successful, it could result in increased pension benefits for those who were unfairly underpaid and provide relief for retirees whose benefits were unlawfully suspended.
